Governor Sonny Perdue Signs Eminent Domain Legislation
Congratulations! Thanks to your efforts in support of our campaign to Curb Eminent Domain abuse, we now have the most stringent Eminent Domain law in the United States. Under the new law, all of GAR’s concerns were addressed:

  • The new law has a stringent definition of blight and public use
  • Established a system of due process to allow citizens to challenge the condemnation of their property by mandating local governments file a petition in Superior Court
  • Assures just and adequate compensation to property owners who suffer a taking
  • Frees property owners from the burden of paying the attorney fees of the condemning authority purpose.

The presumption of public use by government has been eliminated. Each time government wants to condemn a specific property they must file a petition in Superior Court in order to demonstrate that their intended use is a true public

THE FIGHT IS NOT OVER!
The Governor’s legislation includes a constitutional amendment, which further insures that your private property rights will be protected. This will also make sure that the newer stringent law is constitutionally protected and does not get thrown out.
