Beyond BAC: The Drug Impaired Driver training is aimed at both prosecutors and law enforcement officers who handle vehicle crash and impaired driving cases. The course will focus on determining probable cause for a blood draw for drug testing and the importance of drug testing regardless of blood alcohol level. The course will cover the multiple sources of information regarding impairment that officers have available to them at a scene, the current state of the law regarding warrantless blood draws, obtaining the assistance of a Drug Recognition Expert, fully articulating the facts establishing probable cause in search warrants, the limits of hospital blood tests, and laying a proper foundation to get evidence of impairment admitted at trial. The training will include a demonstration of the process that Drug Recognition Experts follow in determining if a driver is impaired by drugs and the category (or categories) of drugs that are likely the cause of impairment. Space is limited to the first 75 registrants.
