Staff Analysis of the Legislation

In addition to allowing anyone with a license to carry a concealed weapon into the State Capitol and its office buildings, HB 981 also allows concealed weapons to be carried into churches, mental hospitals, polling places, bars, school zones and local government buildings unless the private property owner or local government explicitly forbids it.  Furthermore, it only requires that fingerprints be taken for an initial carry license, not renewals. 
 
No local government or law enforcement officer can seize any firearm; require registration of any firearm for which registration is not required; prohibit possession of any firearm in any area not otherwise prohibited; or place any further prohibition on its employees or persons under its direction, control or supervision from carrying firearms.  Those aggrieved could seek relief in court to have the firearm returned and the court shall award the prevailing party (other than local governments) reasonable attorney fees. 
 
Lastly, HB 981 has specific requirements on local governments' handling and disposal of forfeited, confiscated and abandoned firearms.
