HB 1047 changes foreclosure proceedings by adding a new step. A security deed holder can obtain a money judgment prior to foreclosure. The court renders an opinion as to the fair market value of the subject property. The subsequent foreclosure itself then will vary procedurally based upon whether FMV was or was not so determined.
