Staff Analysis of the Legislation

This legislation would restrict counties' and other employers' ability to obtain credit reports on employees or prospective employees unless it is for a bona fide occupational qualification or it is required by law.  A bona fide occupational qualification means that the information contained in the report will be used for a managerial position that sets the direction or control of a business, accesses personal information of customers, employees or employers, involves a fiduciary responsibility to the employer (i.e., issue payments, transferring money or entering into contracts) or has an expense account.  Violation of this proposed law is a misdemeanor punishable be a fine of $200 to $400.
