Staff Analysis of the Legislation

This legislation would allow certain minors convicted of driving under the influence of drugs or alcohol to have their records expunged by filing an application with the district attorney or solicitor. If the district attorney or solicitor denies such a request, the individual may appeal to superior court. The district attorney or solicitor is required to establish that the individual did not meet the requirements of this code section by clear and convincing evidence. If the court finds in favor of the individual, the county or the state may be required to pay attorney's fees and court costs. |
