Staff Analysis of the Legislation

The current House substitute to this proposed Constitutional Amendment (LC 34 4803S) allows the General Assembly by general law to create dedicated trust funds, whereby the proceeds of fees or assessments which are imposed for a specific purpose must be used for that purpose. Currently, under statute, true trust funds do not exist as the monies collected go to the state's general fund and can be redirected for any purpose the General Assembly deems fit.  Under this bill, monies may be redirected, but only if the Governor declares a financial emergency or said redirection is approved by a two-thirds roll call vote of both the House and the Senate.
