Staff Analysis of the Legislation

This legislation only allows an engineering or architectural services contract to require one party to indemnify, hold harmless, insure or defend the other party if the damage is caused by the negligence, recklessness or intentional misconduct. Engineering and architectural service contracts that include provisions requiring indemnification regardless of negligence, recklessness or intentional misconduct are unenforceable.
