Staff Analysis of the Legislation

Amend Article 1 of Chapter 10 of Title 17.  Provide that in making determinations with respect to probation and suspension of sentences, the court may inquire into and consider the legality of a prisoner�s presence in the United States.  Amend Article 2 of Chapter 9 of Title 42 so as to provide that the State Board of Pardons and Paroles may inquire into and consider the legality of a prisoner�s presence in the United States when making parole decisions.
