Staff Analysis of the Legislation

Amend Chapter 9 of Title 16.  It shall be illegal for a owner or operator of a social networking web site to allow a minor using a protected computer to create or maintain a profile web gape on a social networking web site without the permission of the minor�s parent or guardian and without providing such parent or guardian access to such profile web page.  Defines �internet�, �person�, �protected computer�, and �social networking site�.  Any person violating this Code section shall be guilty of a misdemeanor of a high and aggravated nature and on the second offense shall be guilty of a felony and shall be sentenced to imprisonment for not less than one nor more than five years, to pay a fine of $50,000, or both.
