Staff Analysis of the Legislation

Amend Chapter 75 of Title 36.  New code section added (36-75-11).  General Assembly finds that the funding of public safety and judicial facilities projects is accomplished in a more accountable and responsible manner though the issuance of general obligation bonds approved by the voters of the affected local tax jurisdictions.  No county or municipality shall be authorized to activate the need for a public safety and judicial facility authority or a joint public safety and judicial facilities authority.  Any public safety and judicial facilities authority or joint public safety and judicial facility authority created which has not incurred bonded indebtedness shall be prohibited from doing so, and any public safety and judicial facilities authority or joint public safety and judicial facilities authority which has incurred bonded indebtedness shall be prohibited form incurring further bonded indebtedness.
