Staff Analysis of the Legislation

Amend Article 1 of Chapter 17 of Title 45.  Relating to notaries public.  Any person applying for appointment to be a notary public shall be at least 18; be a legal resident of the U.S.; be a legal resident of the county from which such individual is appoint; have and provide at the time of the application; the applicant�s operating telephone number; and be able to read and write the English language.  Proof of county residence can be provided in one of the following formats: valid Georgia driver�s license, valid U.S. passport, valid voter ID, or such other valid ID issued by a local, state, or federal government.  The two people who endorse the notary on the application must have known the notary for at least one month.  Any person who performs any notarial service without complying with the provisions of this article shall, upon the first or second conviction, be guilty of a misdemeanor and upon any third or subsequent conviction be guilty or a felony, punishable by imprisonment of not less than one year nor more than five years, a fine of up to $5,000.00, or both.
