Staff Analysis of the Legislation

Amend Article 9 of Chapter 6 of Title 40.  Relating to speed restrictions.  This bill provides that instruments charging violations of speed regulations shall state whether the violation occurred on a two lane road or highway.  The Department of Driver Services shall administer and collect penalties for the following traffic offenses: driving at a speed of 85MPH or more on any road or highway in GA or 75MPH or more on any two lane road or highway in GA shall be classified as a �super speeder� and a penalty of $200 shall be imposed; any driver with license or privileges suspended shall upon application for reinstatement be subject to a penalty of $100; any driver with license or privileges suspended in whole or in part of a conviction for any traffic violations listed shall upon reinstatement pay a $200 penalty (racing, leaving the scene, fleeing from or attempting to elude an officer); any driver with license or privileges suspended and the suspension is partially based on a conviction for any of the traffic violations listed shall upon application for reinstatement be subject to a penalty of $300 (driving a commercial vehicle with a BAC of .04, DUI, feticide by vehicle, homicide by vehicle, serious injury by vehicle.  Any driver who has been declared a �habitual violator� shall be subject to a penalty of $300 payable upon application for a regular driver�s license.  Any driver who accumulates 7 to 9 points shall be subject to a $100 penalty; 10 to 12 points $125 penalty; 13 to 14 points $200 penalty.  DDS shall notify offenders of the imposition of a penalty under this Code within 30 days after receipt of a qualifying ticket, notice of conviction, or issuance of a license or driving privileges suspension.  Failure to pay within 90 days will result in an additional $50 penalty.  No court shall change, lessen, or modify a traffic law charge in order to avoid the payment of penalties.  All penalties collected go to the General Fund.
