Amend Part 2 of Article 13 of Chapter 6 of Title 40. Relating to motorcycles so as to provide that a driver of a motorcycle approaching an intersection controlled by a traffic-control signal utilizing a vehicle detection device that is inoperative due to the size of the motorcycle shall come to a full and complete stop at the intersection in response to a red light and, after waiting for a reasonable period of time, not less than 20 seconds, for such traffic-control signal to detect such motorcycle, may proceed with due caution when it is safe to do so. The driver of any vehicle approaching the intersection which lawfully may enter the intersection shall have right of way over any motorcycle operator proceeding through a red light and, in no event where an accident results from the driver of the motorcycle proceeding into the intersection on a red light, shall such driver of the vehicle be charged with any violation of Code Section 40-6-70, relating to failure to yield right of way, Code Section 40-6-49, relating to following too closely, or Code Section 40-6-180, relating to driving too fast for conditions.
