Staff Analysis of the Legislation

HB 455 amends Chapter 13 of Title 16, relating to controlled substances. It would enact the “Georgia Prescription Monitoring Program Act”. This bill would provide for the establishment of a program for the monitoring of prescribing and dispensing Schedule II, III, or IV controlled substances by the Georgia Drugs and Narcotics Agency. Dispensers will be required to submit in electronic format information regarding each prescription dispensed for a qualified drug. Prescription information that is submitted will be confidential and not subject to open records requirements. A dispenser who knowingly fails to submit information or knowingly submits incorrect information shall be guilty of a misdemeanor and punished by imprisonment for a period not to exceed 12 months or a fine not to exceed $1,000 or both. Disclosure of confidential information or use of the information for a purpose for which it was not intended will result in imprisonment for a period not to exceed 12 months or a fine not to exceed $1,000 or both.
