Staff Analysis of the Legislation

Amend 17-12-127.  Relating to representation and appointment of alternative attorneys.  Any costs incurred in providing defense services pursuant to the �Georgia Indigent Defense Act of 2003� for person accused of crimes shall not be considered contingent expenses of the superior court.  This bill would change matters relating to appointment of counsel and attorneys� fees in capital cases.   If for any reason the office is unable to defend any indigent person accused of a capital felony the presiding judge of the superior court shall appoint consul.  A maximum of two attorneys shall be paid by the council at an hourly rate established by the council with state funds.  A county governing authority may provide supplemental compensation to appointed counsel.  The presiding judge may not appoint more than one additional attorney to represent the defendant; provided that such attorney shall be paid by the county with county funds at a rate established by the counsel.
