Staff Analysis of the Legislation

Amend 47-2-262.  This bill would amend provisions relating to membership in ERS.  This bill would affect persons who are employed as assistant DA on June 30, 1979, who rejected membership at that time and subsequently began making contributions on July 1, 1998.  Under this bill, such persons would be credited with membership beginning on July 1, 1998.  Additionally, such persons would be entitled to obtain creditable service for prior service as an assistant DA rendered from July 1, 1979 through Jude 30, 1998, provided such service is not being used towards creditable service in any other system.  The member would be required to pay the full actuarial cost of the service granted and payment must be made by December 31, 2008.
