Staff Analysis of the Legislation

Amend 16-11-129.  Relating to a license to carry a pistol or revolver and temporary renewal permits so as to require permits to be issued more quickly.  To provide for temporary permits for initial applicants when permits are delayed without cause.  The law enforcement agency shall notify the judge of the probate court within 30 days (change from 50 days), by telephone and in writing, of any findings relating to the applicant which may bear on eligibility.  Where the applicant is a US. Citizen and no derogatory information is found by either the law enforcement agency ro probate court the court shall issue the applicant a license or renewal within the 45 days required, or all fees shall be retuned to the applicant.  Where the applicant for an initial ices or renewal of a license which expired more than 30 days prior to the application is a U.S. citizen and no information is found on the applicant bearing on eligibility the applicant shall receive a temporary license if 45 days or more have expired since the application was file and no five year license has been issued by the court.  The temporary license shall expire upon the issuance of a five year license, revocation by the court or 12 months from the date of issuance, whichever occurs first.
