Staff Analysis of the Legislation

SR 721 proposes an amendment to the Constitution to prohibit courts from ordering the General Assembly to pass laws, including laws to create or increase taxes or appropriations. This reaffirms that the power of appropriation of state revenues are reserved exclusively to the General Assembly. Also says that appropriations determined by the General Assembly for any Act or program are within the discretion of the General Assembly and no court of this state shall declare an Act or program unconstitutional based upon the exercise of this discretion. This question will be on a ballot and voters will have a chance to vote "Yes" or "No".
