SB 405 provides for the enactment of the "Georgia Revised Uniform Anatomical Gift Act" and repeals the "Georgia Anatomical Gift Act". This bill is concerned with the issue of anatomical gifts and provides definitions as well as determines who may make an anatomical gift and in what manner. It also outlines how to amend or revoke a gift. This bill also prohibits the sale or purchase of body parts while providing for penalties and immunity. A person who intentionally falsifies, forges, conceals, defaces, or obliterates a document of a gift, an amendment or revocation of a document of gift or a refusal for financial gain or commits a felonyand upon conviction is subject to a fine not exceeding $50,000.00 or imprisonment not exceeding five years, or both. A person that knowingly purchases or sells a part for transplantation or therapy if removal of a part from an individual is intended to occur after the individual’s death commits a felony and upon conviction is subject to a fine not exceeding $50,000.00 or imprisonment not exceeding five years, or both.
