Staff Analysis of the Legislation

SB 134 amends Article 2 of Chapter 14 of Title 40 of the O.C.G.A. relating to speed detection devices by closing a loophole in the anti-speed trap law, O.C.G.A. Code Section 40-14-11, which limits fine revenue from speeding violations to 35 percent of a law enforcement agency's budget.  Fines collected for citations issued for violations of Code Section 40-6-180 shall be included when calculating total speeding fine revenue for the agency; provided, however, that fines for speeding violations exceeding 20 miles per hour over the established speed limit shall not be considered when calculating total speeding fine revenue for the agency.
