Staff Analysis of the Legislation

HB 480 amends Article 5 of Chapter 18 of Title 15 of the O.C.G.A., relating to prosecuting attorneys of municipal courts. Section 1 amends Code Section 15-18-91, relating to the creation of the office of prosecuting attorney of municipal court, by substituting Administrative Office of the Courts for the Prosecuting Attorneys' Council, as the entity to which municipalities must provide a copy of the resolution to create the office of prosecuting attorney of the municipal court. Section 2 amends the same code section by substituting the Administrative Office of the Courts for the Prosecuting Attorneys' Council as the entity to which the municipal court clerk must notify of the name of any person appointed to be the prosecuting attorney of a municipal court.

Sections 3 and 4 amend Code Sections 15-18-91 and 15-18-95 to require a municipality to appoint an attorney to serve as the prosecuting attorney of the municipal court. Current law allows municipal governing authorities to create the office of prosecuting attorney in their municipal courts, but does not require them to do so.
