Staff Analysis of the Legislation

            HB 506 seeks to amend Part 1 of Article 4 of Chapter 11 of Title 16 of the O.C.G.A. relating to general provisions relative to dangerous instrumentalities and practices.

            Code Section 16-11-105 is revised to include that it is unlawful for any person to fire or discharge a firearm into the air or otherwise as an act of celebration or ceremony. The Code Section does not apply to law enforcement officers or members of the National Guard or of the armed forces of the U.S. in the performance of their duties. Any person who violates this Code Section shall be guilty of a misdemeanor and shall be punished by a fine of $1,000.00 and, in the discretion of the court, be imprisoned for not more than 12 months.
