Staff Analysis of the Legislation

SB 240 seeks to amend Part 2 of Article 1 of Chapter 8 of Title 40 of the O.C.G.A. relating to lighting equipment for motor vehicles.

It revises Code Section 40-8-22 to specify that headlights shall “emit white light only.” It further delineates that the headlights shall be placed at a height, as measured from the center of the headlight, of between 22 and 54 inches (up from a prior minimum of 24 inches). New subsection (f) is added which mandates that all replacement bulbs and headlights shall utilize the original factory light source as installed by the manufacturer. It shall be unlawful to operate a vehicle with headlights that are converted from a halogen lighting system to a high-intensity discharge system or vice versa.
