HB 680 amends O.C.G.A. Chapter 5 of Title 19, relating to the provisions of divorce. HB 680 provides that the petitioner seeking the divorce may be required to complete four hours of education either in person or online, and no more than 120 days prior to filing the petition for divorce. O.C.G.A. ยง 19-5-4.1 will allow the judges of the probate courts, or their clerks, to provide the education and also stipulates what the education will focus on. Upon completion, written documentation shall be provided to such party. The court may provide payment for indigent parties to complete the education or authorize a provider to provide the education free of charge. If the petition for divorce is not granted, the cost, if any, associated with the education, shall be paid by the participating parties in accordance with each party's ability to pay. HB 680 requires the courts to maintain records of the number of people who complete the education, and the number of people who subsequently file for divorce. This data shall be made available to any entity for research purposes or to the public upon request. |
