Staff Analysis of the Legislation

            HB 688 seeks to amend Chapter 1 of Title 35 of the O.C.G.A. relating to general provisions relative to law enforcement officers and agencies.

            It adds new Code Section 35-1-20 which enforces that no state or local official or law enforcement officer shall take any actions to enforce a federal law, regulation, or order relating to the purchase, possession, or use of a firearm. No arrest, collection of information, or other action in violation of this Code Section shall be valid. Any citizen age 18 or older shall have legal standing to bring an action in the superior court to enforce the provisions of this Code Section. Any person, if successful, shall be entitled to a reasonable attorney’s fee.
