Staff Analysis of the Legislation

      HB 722 seeks to amend Title 16 and Code section 31-2A-18 relating to crimes and offenses and the establishment of the Low THS Oil Patient Registry, respectively. The Act shall be known as “Haleigh’s Hope Act – Part II.”

      The creation of new Code Section 16-12-192 serves to mandate that it shall be lawful for a manufacturer of low THC oil to ship the product to a person registered with the Department of Public Health under Code Section 31-2A-18. Paragraph (16) of Code Section 16-13-21 is revised to exclude “tetrahydrocannabinol” from the definition of “marijuana.”

      It removes from Code Section 31-2A-18 paragraph (c) the requirement for individuals to live in the state for at least one year or a child born in this state less than one year old to be the only ones eligible for registration under this Code Section as well as the mandate that nothing in this Code Section shall apply to Georgia residents living temporarily in another state for the purpose of securing THC oil for treatment of any condition.

      A new paragraph (7) is added to subsection (a) of Code Section 40-6-391 relating to driving under the influence to specify the concentration of delta 9-tetrahydrocannabinol as two nanograms per milliliter or more without regard to whether or not any alcohol is present in the person’s blood or breath.
