Staff Analysis of the Legislation

SB 257 revises O.C.G.A. § 16-11-132.1, relating to the carrying and possession of firearms. Any person who is currently a party: to divorce, under Chapter 5 of Title 19; or who has a petition seeking relief from family violence or a protective order against them, as filed by the opposite party of the proceeding, shall be guilty of a misdemeanor when attempting to purchase a firearm without the written permission for such purpose from the judge presiding over the proceeding. The judge shall grant permission at their discretion, if sufficient facts indicate that a sufficient cooling-off period has occurred since the granting of such petition or protective order. A preponderance of evidence is required, showing that the person attempting to purchase a firearm will not likely act in a manner dangerous to public safety.
