Staff Analysis of the Legislation

HB 847 amends O.C.G.A. Title 16 and Title 49, related to general provisions of public assistance, and to fraud and related offenses. HB 847 provides definitions relating to provisions of public assistance, and specifies the ‘department’ as the ‘Department of Human Services’. It also changes wording from ‘food stamps’ to ‘food instruments’, for the purposes of obtaining public assistance or for the purposes of prosecuting public assistance fraud. HB 847 allows for the deferring of prosecution or indictment if terms are agreed upon by the Department of Human Services and the accused individual.
