Staff Analysis of the Legislation

          HB 918 aims to amend O.C.G.A. Chapter 6 of Title 10 relating to agency, more precisely to powers of attorney.

            This bill seeks to revise many aspects of the process of obtaining, performing as, and terminating of the power of attorney and the financial power of attorney, among which include: the delineation of coagents and successor agents; the process for a principal to obtain a guardian of his or her estate after the execution of a power of attorney; the adaptation of the definition and function of conditional powers of attorney; the procedure for if and when a power of attorney must disclose receipts, disbursements, and transactions conducted on behalf of the principle; the considerations of an agent’s special skills; the reimbursement of funds taken from the power of attorney improperly; responsibilities of notice to safeguard the principal’s interest; the terms for the dissolution or resignation of agency relationship and/or authority; the granting of certification or translation of matters concerning the principal or the agency relationship; and procedures for out of state powers of attorney. Additionally, revisions seek for compliance with Code Section 10-6-140.2 to begin on and continue after July 1, 2016.
