Staff Analysis of the Legislation

HB 1025 revises O.C.G.A. ยง 15-10-62, allowing for the serving of a citation for violating an ordinance concerning the condition of real property. The citation may be served by: leaving a copy of it at the premises where the alleged violation occurred; mailing a copy of it to the owner of such premises at the address of record maintained by the tax commissioner and tax assessor; and filing a copy of it with the clerk of magistrate court. Service under paragraph 1 of this subsection shall not be authorized until there has been at least one attempt at personal service on the accused at the address of record. When the accused who has been served under this subsection fails to appear for a trial, an in rem judgment and lien against the real property shall be the exclusive penalty.
