SB 400 revises O.C.G.A. § 15-6-62.1, by providing the definition for vendor relative to the clerk of the superior court’s duty to back-up electronic records. SB 400 requires that the clerk of the superior court retain the digital format of any record by: permanently retaining the back-up record on their own servers or through a contractual relationship between the clerk and a vendor; and by the clerk submitting all digitally formatted records that the clerk is required to archive, to the authority or the vendor for permanent archiving. The clerk of the superior court shall submit the clerk's records to the authority or vendor in a format acceptable to the authority or vendor at least monthly, but not later than the fifteenth day following the last day of each month.
