HB 1073 seeks to amend Chapter 11 of Title 15 of the O.C.G.A. relating to Juvenile Code. The bill calls for the disallowance of judgments or orders from the juvenile court to be superseded or modified except in the discretion of the trial court, allowing such judgment to stand until reversed or modified by the reviewing court. The appeal of an order granting petition to terminate parental rights must stay an adoption proceeding relating to the child in question until the order becomes final either by the conclusion of the appellate court proceedings or by the expiration of time for seeking such review. Additionally, the bill clarifies that, while a party other than a child does have the ability to waive their right to an attorney, such waiver must be made knowingly, voluntarily, and on the record.
