42 seeks to amend Code Section 40-6-391 and Code Section 42-4-7 of the O.C.G.A.
relating to driving under the influence of alcohol, drugs, or other
intoxicating substances and to maintenance of inmate records by the sheriff and
earned time allowances, respectively. The Act shall be known as the “Jordan
Griner Act.”
Code Section 40-6-391 creates a
mandatory period of imprisonment of no less than 30 days – up from 10 – and no
more than 12 months. It removes provisions which allow the judge’s ability to
suspend, stay, or probate such period. It adds that the judge shall probate at
least a portion of the term in accordance with subparagraph (F) of this
paragraph.
Code Section 42-4-7 is revised so as
to change the prohibition of earned time allowances on behalf of a sheriff, chief
jailer, or warden to include first – instead of only second or subsequent –
offense inmates of driving under the influence. |
