Staff Analysis of the Legislation

            SB 23 seeks to amend Chapter 5 of Title 24 of the O.C.G.A. relating to privileges.

            It strikes the current Code Section 24-5-508 and adds in new code specifying that news procured by a reporter shall be privileged in any proceeding where the one asserting the privilege is not a party, unless it is shown that privilege has been waived or if the material falls under certain categories. A reporter shall not be compelled to disclose in any preceding any details about a source unless upon motion by a party, the court finds by a preponderance of the evidence that the evidence sought falls until certain specifications. If the court finds the evidence to be of such categories, the court shall order that such evidence be produced for the court under seal, shall examine the evidence in camera, and may allow disclosure of those portions of the evidence that the court finds are subject to disclosure under this section.
