Staff Analysis of the Legislation

SB 50 revises O.C.G.A. § 15-18-5, relating to the appointment of an absent or disqualified district attorney. When a law enforcement officer whose duties are within the same circuit as the district attorney and the officer is alleged to have committed a felony or an act of family violence, the district attorney shall notify the Attorney General of such prosecution. The Attorney General shall appoint a district attorney.
