Staff Analysis of the Legislation

SB 46 revises O.C.G.A. § 35-1-20 by mandating that on and after January 1, 2017 by requiring all law enforcement agencies in the state to equip all peace officers, whose primary duties are responding to traffic stops and respond to emergency dispatch calls, with an audio and video recording device. Law enforcement agencies which do not with these requirements shall be subject to withholding of any state or federal funding. The commissioner of public safety shall create rules and regulations for the awarding of financial grants to agencies to fund the mandate. Recordings dealing with pending investigations or prosecution shall not be required to public disclosure, pursuant to O.C.G.A. § 50-18-72. Any recordings made by peace officers pursuant to O.C.G.A. § 35-1-20 shall be lawful recordings.
