Staff Analysis of the Legislation

SB 45 amends O.C.G.A. Article 2 of Chapter 5 of Title 17, relating to no-knock warrants. O.C.G.A. § 17-5-21 is revised to provide that no search warrant shall be issued which contains a no-knock provision unless the testimony supporting such warrant established a probable cause that if an officer were to identify themselves, such act would likely pose a significant and imminent danger to human life or evidence being destroyed. When a warrant does not contain a no-knock, the officer may use necessary and reasonable force if the presence of any individual within the building is unknown.
