Staff Analysis of the Legislation

SB 71 revises O.C.G.A. § 35-1-20 by mandating that on and after January 1, 2017 all law enforcement agencies in the state shall equip all peace officers whose primary duties are responding to traffic stops and respond to emergency dispatch calls, with an audio and video recording device. Law enforcement agencies which do not comply with these requirements shall be subject to withholding of any state or federal funding. Recordings dealing with pending investigations or prosecution shall not be required to public disclosure, pursuant to O.C.G.A. § 50-18-72. Any recordings made by peace officers pursuant to O.C.G.A. § 35-1-20 shall be lawful recordings.
