Staff Analysis of the Legislation

HB 182 amends O.C.G.A. ยง 40-5-67.1, relating to driving under the influence of drugs, alcohol, or other prohibited substances. The bill eliminates the ability of the state to obtain a search warrant to acquire evidence from a driver who does not voluntary consent to a breath test, unless the driver was involved in a traffic accident that resulted in serious injuries or fatalities. The revised Code Section also provides a definition for 'serious injuries.'
