Staff Analysis of the Legislation

SB 86 repeals O.C.G.A. Title 51 Chapter 13 in its entirety and creates a new chapter under the same nomenclature. SB 86 creates the Patient Compensation System within the Department of Community Health with the purpose of ensuring that every applicant is provided high-quality assistance through the process. This legislation further stipulates the employees, board members, and other individuals of the System and powers of each office. Finally, the bill provides the procedures for applicants to file an application of medical injuries with the System. Nothing in this chapter shall be construed prohibit an offer of early settlement or an apology in satisfaction of a medical injury. Applications filed under this chapter shall not constitute a claim for medical malpractice.
