Staff Analysis of the Legislation

HB 267 amends Title 44 relating to property. O.C.G.A. § 44-5-30 is revised so as to provide that a deed to lands shall be attested by an officer, pursuant to O.C.G.A. § 44-2-15, and attested by one other witness. A mortgage to record shall be signed by the maker, attested by an officer, and another witness. Mortgages made outside of this state and deeds secured to record debt or bills of sales shall follow the same regulations regarding attestment.
