Staff Analysis of the Legislation

HB 304 amends Code Section 17-10-1 of the Official Code of Georgia Annotated, relating to the fixing of sentences, so as to clarify service of consecutive sentences. In cases of imprisonment followed by probation, the sentence shall specifically provide that the period of probation not begin until the defendant has completed full service of the confinement portion of the sentence even when consecutive sentences are imposed wherein one of the sentences requires a mandatory period of probation. This does govern the Department of Corrections in the computation of time that sentences shall run. HB 304 revises O.C.G.A. 17-10-6.2, relating to the punishment of sexual offenders, by applying the previous mentioned provisions of O.C.G.A. ยง 17-10-1, to this code section.
