Staff Analysis of the Legislation

            SB 127 seeks to amend Title 21 of the O.C.G.A. relating to elections.

            Code Section 21-2-8 relating to primaries and elections specifies instances in which candidates maintain eligibility for candidacy in regard to outstanding fees, fines, and penalties.

            Subsection (c) of Code Section 21-2-212 is stricken.

             The bill removes the stipulation that municipal registrars must be registered Georgia voters and shall be able to read, write, and speak English. It adds “a legible photocopy of the applicant’s Bureau of Indian Affairs card, tribal treaty card, or trial enrollment card” as acceptable verification of citizenship. It further stipulates procedure for voters with address changes or voters who move out of state.

            New Code Section 21-5-7.2 is added. It authorizes the commission to waive late fees, fines, and civil penalties incurred by candidates for public office and delineates how a candidate may obtain such a waiver. It also permits candidates to demand hearings before the Office of State Administrative Hearings and reserves the right for the commission to revoke the waiver if it was presented under false pretenses.
