Staff Analysis of the Legislation

HB 375 amends Title 40, relating to motor vehicles, so as to provide for different criteria for driving under the influence of marijuana. HB 375 strikes the term marijuana from O.C.G.A. 40-5- 75. HB 375 also revises O.C.G.A. 40-6-391 by inserting a new paragraph into subsection (a); this new paragraph states that a person shall be prohibited from driving when analysis of the person’s blood shows the concentration of delta 9-tetrahydrocannabinol is two nanograms per milliliter or 92 more.
