Staff Analysis of the Legislation

HB 381 is based on a uniform act and is a comprehensive rewrite of the state's notarial laws. The legislation would be known as the "Revised Georgia Law on Notarial Acts of 2015." It would require notaries to be a United States citizen, pass an online test administered by the Georgia Superior Court Clerks' Cooperative Authority, submit to a fingerprint based background check, and pay a nominal fee. Notaries would also be required to maintain a journal of the documents they notarize for 10 years after their last notarial act. It would allow tamper-proof electronic notary seals on electronic documents. 

The effective date is July 1, 2016, to allow the clerks offices time to obtain needed equipment.
