HB 34 aims to amend Title 42 of the OCGA by allowing certain and serious offender records and files to be open and accessible. It also redistributes responsibilities of the State Board of Pardons and Parole, Department of Community Supervisor, superior courts, and district attorneys. These changes include but are not limited to: the Department now holds legal custody of the parolee, the superior court that imposes sentences on the parolee is now responsible for determining and taking actions on parole violations, the district attorney is now responsible for issuing subpoenas, and the Board must now hold public hearings before releasing someone from parole. |
