Staff Analysis of the Legislation

HB 51 amends Article 1 of Chapter 3 of Title 20 of the OCGA. HB 51 requires postsecondary institutions to report crimes to the campus law enforcement or other appropriate law enforcement. If the alleged crime is sexual assault, no information can be provided without the consent of the victim. The law enforcement agency will then determine to investigate the alleged crime, but the postsecondary institution cannot investigate the crime itself. The postsecondary can still pursue disciplinary actions for students, but they cannot if the student is under way for an ongoing criminal investigation.
