Staff Analysis of the Legislation

HB 120 amends Title 45 of the OCGA by setting notary guidelines, duties, and restrictions for notarial acts performed on or after July 1, 2018. To be a notary you must be at least 18 years old, a U.S. citizen, be able to read and write in English, submit fingerprints to the sheriff county, and not be convicted of a felony or crime involving fraud, dishonesty, or deceit. One restriction is that notarial officers cannot notarize their spouse. The Georgia Superior Court Clerks’ Cooperative Authority will maintain an electronic data base of notaries public.
