Staff Analysis of the Legislation

SB 74 amends §15-11-684 by providing that, in assessing a minor’s waiver of the parental notification requirement for an abortion, the court must find clear and convincing evidence that the minor is mature enough and well enough informed to make the decision to proceed with an abortion. The court can also grant the petition of a waiver if the notice to a parent or guardian is shown to not be in the best interests of the minor.
